Important signer requirements
Even with an attorney involved, the notarial part of the appointment has its own conditions.
- The notary must be able to identify each signer using acceptable identification or another method allowed under applicable law.
- The notary must be able to communicate directly with each signer at the appointment.
- The notary must be able to determine that each signer is acting willingly for purposes of the notarization.
- Documents that must be signed in the notary's presence should not be signed in advance.
- The notary does not draft documents, does not explain what a provision means, and does not advise on which documents a client should sign — those questions belong to the attorney or preparer.
